THC Oil, Cannabis Oil, or Marijuana Oil, are they Legal to Buy?

One of the biggest questions on the minds of individuals thinking about using medical cannabis be it THC oil, cannabis oil, or marijuana oil, is whether or not it is legal to purchase. This is indeed an important question, and this is largely because medical cannabis oil can be derived from either the marijuana plant or the industrial hemp plant, each of which comes with its own legal status. Furthermore, states have their own medical cannabis laws, adding to the already complicated web of legality. If that was not bad enough, the Drug Enforcement Administration (DEA) contends that “marijuana extracts” are illegal under Schedule 1 of the Controlled Substance Act (CSA). Still, under federal law “marijuana extracts” can be seen as legal under specific scenarios based on the definition of marijuana under CSA: extracts are derived from the “mature stalk” of the cannabis plant; extracts are derived from an industrial hemp plant lawfully grown in a State that has enacted hemp laws in compliance with the 2014 Farm Bill; and extract sourced from industrial hemp. How do you know if THC oil, cannabis oil, or marijuana oil is legal to purchase?

What is THC Oil?

THC oil is extracted from the marijuana plant and is known for its high concentration of THC. While it can produce certain medicinal effects, it is also known to produce a “high” in users, that can result in a change in perception, behavior, and mood.

What is Cannabis Oil?

Cannabis oil is any concentrated extract of the cannabis plant’s chemical compounds, such as THC and CBD. However, it generally refers to oil made from marijuana because the oil tends to have a much higher concentration of THC and varying consistencies. Cannabis oil is popularly used for vaporization and dabbing.

What is Marijuana Oil?

Marijuana oil is often synonymous with THC oil and cannabis oil, and is produced with a high concentration of THC and CBD alike, but it is mainly used for its high THC content.

The big question is whether or not it is legal to buy THC oil, cannabis oil, or marijuana oil? The answer to that question is not a simple yes or no. It is a bit more complicated than that. It is important to consider the actual source and content of the oil in order to make a legal distinction, and the state where you reside.

Know Your State Cannabis Laws

There are currently 29 states that have enacted medical marijuana legislation, along with the District of Columbia, and each has its own regulations, requirements, and limitations. One instance in which you can buy cannabis oil legally in the United States is if your state allows the sale of the product. State medical marijuana laws tend to vary, and some are broader than others, and allows those suffering from certain rare medical illnesses to acquire medical cannabis without the fear of prosecution. You may feel tempted to buy THC oil, cannabis oil or marijuana oil online, however, it is crucial to remember that the only form of medicinal cannabis oil that is legal to purchase has to be derived from industrial hemp plants.

Buy Hemp-CBD Oil as an Alternative

Hemp-CBD oil has been implicated as having considerable medicinal value, but without the psychoactive effect or “high” that is associated with high-THC medicinal cannabis products. This is a legal alternative to THC oil, cannabis oil, and marijuana oil, not only because it has a high content of CBD and low levels of THC, but because CBD derived solely from mature hemp stalks is legal throughout the US, and currently 16 states with CBD-specific laws. Furthermore, CBD extracted from the flowers and leaves is only legal to purchase if produced and sold in a state which has enacted hemp laws pursuant to the 2014 Farm Bill.

While you may feel the need to try medicinal cannabis, whether in the form of THC oil, cannabis oil, or marijuana oil for an ailment that you need to treat or cure, it is essential to be mindful of the legal status of the cannabis product. Buying medicinal cannabis products can be tricky because of the DEA classification of cannabis as an illegal substance. However, when in doubt about what cannabis product you can purchase legally, one of the first things that you can do is check to see what your state allows. Furthermore, a better legal alternative appears to be hemp-CBD oil that has minimal amounts of THC and high CBD component, and several states have established CBD-specific laws, making it possible to legally acquire CBD oil. In order to be on the right side of the law, it is important that consumers be informed about the legalities of medicinal cannabis.
